Virginia Cannabis Laws 2025: Medical & Recreational Update

Virginia’s cannabis landscape has undergone significant changes in recent years, with evolving policies and regulations shaping the medical and recreational use of cannabis. Here’s a comprehensive update on the status of cannabis laws in Virginia as of 2025.

Medical Cannabis in Virginia

Virginia’s medical cannabis program allows qualified patients to access cannabis for medical use. To participate, patients must obtain a written certification from a licensed practitioner. Once certified, patients can purchase cannabis products from licensed dispensaries without the need for additional registration with the state Board of Pharmacy, a change that took effect in July 2022. Patients are required to renew their certifications annually, and they must be residents of Virginia, at least 18 years old. Parents or legal guardians can certify for minors or vulnerable adults. The law no longer requires patients to register with the state Board of Pharmacy in order to access the program—a change that took effect in July 2022. Virginia Mercury

Home Cultivation Regulations

Adults aged 21 and over in Virginia are permitted to cultivate up to four cannabis plants per household for personal use. These plants must be labeled with the grower’s name and kept out of public view. It’s important to note that selling home-grown cannabis remains illegal. Vanderpool, Frostick & Nishanian, PC

Recreational Cannabis Sales

As of now, recreational cannabis sales are not yet operational in Virginia. While the 2025 General Assembly approved measures to establish a retail cannabis market, Governor Glenn Youngkin vetoed the legislation, citing concerns over public health and safety. Without the governor’s approval, the bills did not become law. AP News

In Norfolk, cannabis dispensaries are subject to zoning regulations. They may not be located within 1,000 feet of a school or childcare facility or another cannabis dispensary. Dispensaries are permitted to operate between 7:00 a.m. and 10:00 p.m. Norfolk Government
